By accessing or using the Service in any way — including browsing the website, initiating a video chat session, or using any feature of the platform — you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. We are not responsible for any interruptions caused by internet connectivity issues, browser incompatibilities, or technical failures beyond our control. 04 ## User Conduct You are solely responsible for your conduct while using ChickRoulette. By using the Service you agree to behave in a manner that is lawful, respectful, and consistent with these Terms. Violation may result in permanent ban and reporting to law enforcement. You must not display, share, transmit, or otherwise make available any content that: - **Involves minors in any sexual or suggestive context.** This is a zero-tolerance policy and will result in immediate termination and reporting to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement. - Is sexually explicit and involves non-consenting individuals - Constitutes hate speech, including content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, or disability - Depicts or promotes real-world violence, self-harm, or suicide - Facilitates or promotes illegal activities of any kind - Violates the privacy or intellectual property rights of any third party - Is defamatory, fraudulent, or misleading ChickRoulette provides in-session reporting tools. If you encounter prohibited content, use the report function immediately. We take all reports seriously and review them promptly. 06 ## Intellectual Property The ChickRoulette name, logo, website design, graphics, text, code, and all other content on the platform (“ChickRoulette Content”) are the exclusive property of ChickRoulette and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to: - Reproduce, distribute, or publicly display any ChickRoulette Content - Create derivative works based on ChickRoulette Content - Use ChickRoulette’s name, logo, or branding without prior written consent - Scrape, crawl, or index the platform for commercial purposes Any content you transmit during a video or text session remains your own. By using the Service, you represent that you have all necessary rights to transmit such content and that doing so does not violate any third-party rights. 07 ## Disclaimers THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CHICKROULETTE DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO: - Warranties of merchantability, fitness for a particular purpose, and non-infringement - Any warranty that the Service will be uninterrupted, timely, secure, or error-free - Any warranty regarding the accuracy or reliability of results obtained through the Service - Any warranty regarding the conduct, identity, or intentions of other users ChickRoulette is not responsible for the behaviour, content, or actions of any user of the platform. You interact with other users entirely at your own risk. We strongly advise you never to share personal identifying information during chat sessions. 08 ## Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHICKROULETTE AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. This includes but is not limited to: - Loss of data, revenue, profits, or goodwill - Emotional distress or harm arising from interactions with other users - Unauthorised access to or alteration of your transmissions - Statements or conduct of any third party on the Service - Any other matter relating to the Service In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law. 09 ## Indemnification You agree to indemnify, defend, and hold harmless ChickRoulette and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: - Your use or misuse of the Service - Your violation of these Terms - Your violation of any rights of a third party - Any content you transmit through the Service - Your violation of any applicable law or regulation 10 ## Termination ChickRoulette reserves the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without notice, at our sole discretion. Reasons for termination may include but are not limited to: - Violation of these Terms or our Community Guidelines - Engaging in prohibited conduct or transmitting prohibited content - Abuse of the reporting system - Suspected fraudulent, abusive, or illegal activity Upon termination, your right to access and use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability. 11 ## Governing Law These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
